DUPLI-COLOR PRODUCTS RESTORATION CHALLENGE OFFICIAL RULES

  1. ELIGIBILITY: The Dupli-Color Products Restoration Challenge (the "Challenge") is open only to individuals who are legal residents of the United States and are eighteen (18) years or older at the time of entry. Employees of The Sherwin-Williams Company, Anthony Thomas Advertising, and their related companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Challenge is subject to all Federal, state, and local laws and regulations and is void where prohibited by law.
  2. SPONSOR: The Challenge is sponsored by The Sherwin-Williams Company, Dupli-Color Products Group, 101 Prospect Avenue, N.W., Cleveland, Ohio 44115 ("Sponsor").
  3. AGREEMENT TO OFFICIAL RULES: By entering the Challenge, you indicate your full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of the Sponsor which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein
  4. ENTRY PERIOD: The Challenge begins on March 27, 2010 at 12:00:01 am Eastern Time ("ET") and ends on July 18, 2010 at 11:59:59 pm ET (the "Entry Period"). Entries received outside of the Entry Period will be disqualified.
  5. ENTRY: This Challenge involves the restoration of any land motor vehicle (Car, Truck, Van, SUV, Motorcycle, or Bus). The restoration must be a do-it-yourself project of at least the exterior of the vehicle involving body work. Use of Dupli-Color products is not required. The restoration project must be substantially completed without the help or assistance of any body shop or professional restorer or mechanic in their professional capacity. If such professional services are utilized, it must be on a very limited basis and thoroughly explained in the written description portion of the entry. The restoration must not have been completed prior to January 1, 2000. To enter, you must submit the following: (a) a picture of the vehicle before the restoration; (b) a picture of the vehicle after the restoration; and (c) a written description of your restoration project including the types of products used and any outside or professional assistance (limited to 500 words) to support your entry. The before and after pictures should show the vehicle from a similar angle and light and may not be edited, altered, or touched up in any way. You may submit your entry online at www.restorationchallenge.com. By entering, you represent and warrant that (a) you substantially restored the vehicle yourself, (b) you own and possess the restored vehicle at the time of entry, (c) your entry does not violate any third party's rights, (d) to the extent your entry depicts any person other than yourself, that person has authorized you to submit the entry into the Challenge and that you can make a written copy of such authorization available to Sponsor upon request; and (e) that you have complied with these Official Rules. There is a limit of one (1) entry per person, household, or street address. Any additional entries will be void. Entries that are incomplete or that contain errors, trademarks/logos (except for the trademarks/logos associated with the restored vehicle), copyrighted images, inappropriate/derogatory/defamatory images, language, nudity, or profanity will be disqualified. Sponsor is not responsible for lost, late, misdirected, altered, or destroyed entries.
  6. JUDGING; ODDS: A panel of judges comprised of automotive professionals will judge all entries by August 1, 2010 to reach a field of 32 entries. Entries will be judged based on the following Judging Criteria: (a) quality of the do-it-yourself restoration with minimal professional assistance (40%); (b) use of products on various areas of the vehicle (30%); and (c) the overall appearance of the vehicle upon completed restoration (30%). Sponsor reserves the right to physically examine a vehicle during the judging process. The 32 entries will then be seeded based on the Judging Criteria into brackets. The 32 entries within the brackets will be posted online at www.restorationchallange.com by August 2, 2010. If Sponsor does not receive 32 qualified entries, it may post a smaller number of entries, at its discretion. Sponsor reserves the right to edit or summarize any written entry and pick vehicle picture (if multiple pictures submitted) prior to posting on the website. Visitors to the site will have the opportunity to vote on their favorite restored vehicles during 5 rounds of match-ups. Round 1 will have 16 match-ups. Round 2 will have 8 match-ups. Round 3 will have 4 match-ups. Round 4 will have 2 match-ups. Round 5 will have 1 match-up. Voting for each round shall be as follows:

  8. There is a limit of one (1) vote per match-up per round per person/e-mail address. The vehicles with the most votes for each head-to-head match-up will advance to the next round. The restored vehicle obtaining the most electronic votes at the end of Round 5 shall be declared the Grand Prize winner of the Challenge. Each of the remaining 31 entries will also receive a prize as described in Section 8 below based on the advancement to rounds and the votes received. In the event of a tie, the judges will select winners based on the Judging Criteria. The odds of winning depend on the relative performance, number of entries received, and number of votes received. If the potential winners cannot be contacted within ten (10) days after the first attempt to make contact, such potential winners will be deemed to be ineligible and disqualified. In such event, Sponsor may select alternate potential winners based on the number of votes received and the Judging Criteria.
  9. REQUIREMENTS OF THE POTENTIAL WINNERS: Except where prohibited, the potential winners may be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within five (5) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, such potential winner will be deemed to be ineligible and disqualified. In such event, Sponsor may select an alternate potential winner based on the number of votes received and the Judging Criteria. If a potential winner is a minor, his/her parent or legal guardian will be required to sign the Affidavit/Release on the potential winner's behalf.
  10. PRIZES: One (1) Grand Prize: The Grand Prize winner will receive a prize package consisting of the following: (a) round-trip coach air transportation for winner and one (1) guest from the major airport nearest winner's home in one of the 48 contiguous United States to Nashville, TN on a carrier selected by Sponsor in its sole discretion; (b) hotel accommodations (double occupancy) for two (2) nights; (c) an opportunity to be interviewed on PowerBlock TV; and (d) US $10,000 in cash. The trip must be taken between October 1, 2010 and December 31, 2010. If the winner does not live in the contiguous United States, he/she will be responsible for the costs of traveling to the contiguous United States. All expenses not specified herein, including but not limited to, meals, taxes, insurance, and gratuities are the sole responsibility of the Grand Prize winner. Winner's guest must be at least 18 years of age and winner and guest must travel together on the same itinerary. Winner's guest will be required to sign a publicity/liability release prior to the booking of the trip. Approximate retail value of the Grand prize package: $12,500. Actual value depends on certain factors including but not limited to air transportation and actual cost of accommodations at time of reservation. If actual value turns out to be less than the stated approximate retail value, the difference will not be awarded in cash. Travel arrangements must be made through Sponsor's travel office and trip must be taken on the dates specified above. One (1) Second Place Prize: a US $500 Advance Auto Parts Gift Card, to be provided by Sponsor to the runner-up of the Round 5 match-up. Two (2) Third Place Prizes: a US $200 Advance Auto Parts Gift Card, to be provided by Sponsor to the entrants that advanced to Round 4 but not Round 5. Four (4) Fourth Place Prizes: a US $100 Advance Auto Parts Gift Card, to be provided by Sponsor to the entrants that advanced to Round 3 but not Round 4. Eight (8) Fifth Place Prizes: a US $75 Advance Auto Parts Gift Card, to be provided by Sponsor to the entrants that advanced to Round 2 but not Round 3. Sixteen (16) Sixth Place Prizes: a US $50 Advance Auto Parts Gift Card, to be provided by Sponsor to the entrants that were seeded in Round 1 but did not advance to Round 2. General Prize Terms: The Advance Auto Parts Gift Cards are subject to the terms and conditions as specified by Advance Auto Parts. Any prize details not specified above will be determined by the Sponsor in its sole discretion. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize (or component thereof) with another prize (or component thereof) of equal or greater value if the prize is not available for any reason, as determined by the Sponsor in its sole discretion. Winners responsible for any and all other costs and expenses not listed above. The value of the prizes may be treated as income to a winner and the winner will be responsible for payment and reporting of all applicable taxes.
  11. PUBLICITY/LICENSE: Except where prohibited, participation in the Challenge constitutes each winner's consent to (a) Sponsor's use of winner's name, likeness, voice, opinions, biographical information and state of residence; and (b) a non-exclusive license to reproduce winner's entry and photographs, or any portions thereof, for promotional purposes in any media without further payment or consideration.
  12. GENERAL CONDITIONS: Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Challenge, or to be acting in violation of these Official Rules. Any attempt by any person to undermine the legitimate operation of the Challenge may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. In the event that the operation, security, or administration of the Challenge is impaired in any way for any reason, Sponsor may, in its sole discretion, either (a) suspend the Challenge to address the impairment and then resume the Challenge in a manner that best conforms to the spirit of these Official Rules, or (b) select winners according to the Judging Criteria from among the eligible entries received up to the time of the impairment, with or without reference to the public votes. Sponsor's failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of any winner based on an e-mail address, the winning entry will be declared by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
  13. RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Challenge, entrants agree to release and hold harmless Sponsor and its respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Challenge or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Challenge; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Challenge or the processing of entries; (e) any incorrect or inaccurate entry information; (f) inability to access the Sponsor's website; or (g) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Challenge or receipt of any prize. Entrant further agrees that in any cause of action, Sponsor's liability will be limited to the cost of entering and participating in the Challenge, and in no event shall Sponsor be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
  14. DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Challenge or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Ohio; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Challenge, but in no event attorneys' fees and/or related legal or other expenses; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Challenge, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.
  15.     7. DRAWINGS AND ODDS: After each Round, Sponsor will conduct a random drawing from among all eligible entries received for that particular Round. Non-winning entries will NOT be carried forward. The drawing for each Round will be limited to the entries received for that particular Round. Odds of winning depend on the number of eligible entries received for each Round. Sponsor will attempt to notify the potential winners by email within ten (10) days of each drawing. Potential winners must provide street address within ten (10) days of being contacted by Sponsor in order for Sponsor to send prize. Entries will be judged based on the following Judging Criteria: (a) quality of the do-it-yourself restoration with minimal professional assistance (40%); (b) use of products on various areas of the vehicle (30%); and (c) the overall appearance of the vehicle upon completed restoration (30%). Sponsor reserves the right to physically examine a vehicle during the judging process. The entries will be posted on www.restorationchallange.com and consumers will be able to vote for their favorite entry in each category according to the schedule set forth below. If Sponsor does not receive ten (10) qualified entries in a category, it may post a smaller number of entries, at its discretion. Sponsor reserves the right to edit or summarize any written entry and pick vehicle picture (if multiple pictures submitted) prior to posting on the website.

    8. There is a limit of one (1) vote per person/e-mail address per category. The entrant that receives the most votes in each category will be a potential Grand Prize winner. All other entrants will be Second Prize winners. In the event of a tie, the judges will select winners based on the Judging Criteria. The odds of winning depend on the relative performance, number of entries received, and number of votes received. If the potential winners cannot be contacted within ten (10) days after the first attempt to make contact, such potential winners will be deemed to be ineligible and disqualified. In such event, Sponsor may select alternate potential winners based on the number of votes received and the Judging Criteria.
    9. REQUIREMENTS OF THE POTENTIAL WINNERS: Except where prohibited, the potential winners may be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within five (5) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, such potential winner will be deemed to be ineligible and disqualified. In such event, Sponsor may select an alternate potential winner based on the number of votes received and the Judging Criteria. If a potential winner is a minor, his/her parent or legal guardian will be required to sign the Affidavit/Release on the potential winner's behalf.
    10. PRIZES: Five (5) Grand Prize winners (one per Category) will each receive $1,000. Forty-five (45) Second Place Prize winners (nine per Category) will each receive a US $25 Advance Auto Parts Gift Card. The Advance Auto Parts Gift Cards are subject to the terms and conditions as specified by Advance Auto Parts. Any prize details not specified above will be determined by the Sponsor in its sole discretion. No cash or other substitution may be made, except by the Sponsor, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by the Sponsor in its sole discretion. Winners responsible for any and all other costs and expenses not listed above. The value of the prizes may be treated as income to a winner and the winner will be responsible for payment and reporting of all applicable taxes.
    11. PUBLICITY/LICENSE: Except where prohibited, participation in the Challenge constitutes each winner's consent to (a) Sponsor's use of winner's name, likeness, voice, opinions, biographical information and state of residence; and (b) a non-exclusive license to reproduce winner's entry and photographs, or any portions thereof, for promotional purposes in any media without further payment or consideration.
    12. GENERAL CONDITIONS: Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Challenge, or to be acting in violation of these Official Rules. Any attempt by any person to undermine the legitimate operation of the Challenge may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. In the event that the operation, security, or administration of the Challenge is impaired in any way for any reason, Sponsor may, in its sole discretion, either (a) suspend the Challenge to address the impairment and then resume the Challenge in a manner that best conforms to the spirit of these Official Rules, or (b) select winners according to the Judging Criteria from among the eligible entries received up to the time of the impairment, with or without reference to the public votes. Sponsor's failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of any winner based on an e-mail address, the winning entry will be declared by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
    13. RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Challenge, entrants agree to release and hold harmless Sponsor and its respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Challenge or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Challenge; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Challenge or the processing of entries; (e) any incorrect or inaccurate entry information; (f) inability to access the Sponsor's website; or (g) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Challenge or receipt of any prize. Entrant further agrees that in any cause of action, Sponsor's liability will be limited to the cost of entering and participating in the Challenge, and in no event shall Sponsor be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
    14. DISPUTES: Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of, or connected with, the Challenge or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Ohio; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Challenge, but in no event attorneys' fees and/or related legal or other expenses; and (c) entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Challenge, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of the State of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Ohio.
    15. CHALLENGE RESULTS: For winners' names, available after October 4, 2010, send a separate, self-addressed, stamped envelope to Dupli-Color Products Restoration Project Challenge, c/o Anthony Thomas Advertising, 380 South Main Street, Akron, Ohio 44311. All requests must be received by October 1, 2010. Winners will also be posted on www.restorationchallenge.com.
